Step 2 – Commencement of proceedings

Commencement of proceedings

The rules for how soon prosecution for classification enforcement offences must commence after the alleged offence vary depending on your jurisdiction. Generally there is no time limit for prosecution of child pornography offences unless specified below.

ACT

Proceedings must start within one year of the date of classification of material

NSW

Proceedings must start within one year of the date of classification of material OR one year from the date of agreement to 'classification by consent'

NT

Proceedings must start within two years of the alleged offence

Qld

No time limit for when proceedings can start

SA

Proceedings must start within two years of the alleged offence

Tas

Proceedings must start within one years of the alleged offence for classification offences OR within two years of the alleged offence for child abuse or bestiality offences.

Vic

Proceedings must start within one year of the date of classification of material

WA

Proceedings must start within one year of the date of classification of material OR one year from the date of agreement to “classification by consent”
