Essential requirements

You may make a written request for permission to import 'objectionable goods' to the Director of the Classification Board.

In considering whether to grant a permission to import, the Director is to have regard to the following matters in subregulation 4A(2AA) of the Regulations:

  1. the purposes for which the goods are to be imported, and
  2. the extent to which the person to whom any permission to import the goods would be granted conducts activities of an artistic or educational, or of a cultural or scientific, nature to which the goods relate, and
  3. the reputation of the person referred to in paragraph (b), both generally and in relation to an activity referred to in that paragraph, and
  4. the ability of that person to meet conditions that may be imposed under subregulaton (3) in relation to the goods, and
  5. any other relevant matters.

Conditions under subregulaton (3) may include certain restrictions or prohibitions with respect to the custody, use, reproduction, disposal, destruction or exportation of the goods, or with respect to accounting for the goods.

Your request for permission to import 'objectionable goods' must adequately address each of the matters outlined above and be accompanied by relevant supporting documentary evidence. Importation for personal use or entertainment is generally not considered a sufficient reason for granting permission. If you are considering importing 'adult material' for personal use or distribution, you should ensure that the material does not contain any elements that would be considered 'objectionable' before purchasing; otherwise you risk seizure of the goods by Customs.
