Who can apply?
Those entitled to seek a review are:
- The Minister
- The original applicant for classification
- The publisher of the film, publication or computer game, and
- A ‘person aggrieved’ by the decision.
State and Territory Ministers who are responsible for censorship issues in their jurisdiction can also seek a review by asking the Australian Minister to review the classification decision. If asked, the Australian Minister must seek a review.
A ‘person aggrieved’ is broadly defined in section 42 of the Classification (Publications, Films and Computer Games) Act 1995 as someone who can demonstrate an interest in the subject matter of the work in question that extends beyond that of an ordinary member of the public.
What do I have to do?
Applications for review should be made in writing on the correct form and must be accompanied by the correct fee. The application form for review can be downloaded from this page, and information about fees can be located in the fees for classification – fees for other services section.
The form submitted without the fee or a written application for a fee waiver is not a valid application. View information about fee waivers on the Fee Waivers page.
Applications must generally be made within 30 days of receipt of notice of the relevant decision by the Classification Board.
